How Expert Witnesses Are Involved in Lawsuits

We all know that DNA plays a critical role in a criminal trial thanks to the things we’ve learned watching court room dramas on television. Nobody, however, really talks about the witnesses testifying on such evidence.

A trial is actually a fairly simple procedure. The law sets for the elements that must be proved. The parties then argue their sides of each issue. Problems arise, however, when the subjects being argued over get complex.

The world is so complex that nobody can understand everything. This can be particularly true on a jury. Expert witnesses have the role of making the complicated simple for a jury. Consider the following.

There are times when people allow themselves to be intimidated by different systems that they become involved in during their lives. One intimidating system in the health care system and the other is the legal system. The sad thing about this is when people allow their fears get in the way of being served well. So often people feel that doctors and lawyers know everything in their field and they do not make mistakes. This is ridiculous. Everyone makes mistakes and they should be called on them when it happens. This does not mean you need to turn to a law suit, but you can request a second opinion. I have found through the years that for every doctor you go to you will get another opinion. The key is to find a doctor that will listen to you and will learn from you about your body and symptoms.

Have you ever thought about how complicated the legal system has made our lives? There are times when I hear about different law suits and court actions and I want to scream at the stupidity of our court systems time being filled with frivolous cases. I understand that there is a need for attorneys and that many of the cases they handle are important and involve human rights; however there are also many cases that they handle that have no merit. Instead of people thinking of attorneys as helping individuals, they see them as publicity seekers looking for big cuts of high settlements.

Lemon Law

Every state in the USA has a version of the lemon law. The lemon law and qualification requirements are not exactly the same from state to state, but the fundamental rights recognized by law provide essentially the same level of protection. Therefore, if you buy a car that turns out to be a “lemon,” you are entitled to a refund or replacement vehicle. But you should know your state’s law before claiming your lemon.

Your state has probably also a certain type of law that requires automakers to honor car guaranteed under certain conditions. These laws may also vary from one State to another. It’s up to you as the consumer to do research to determine the laws and statutes in your state.
